Welcome to LearnerBit (“LearnerBit,” “we,” “our,” or “us”), a K–12 Artificial Intelligence and STEM learning platform owned and operated by Brainy n Bright Inc., including its subsidiaries in Dubai, Abu Dhabi, and India. By accessing or using LearnerBit, including its websites, mobile applications, learning management systems (LMS), courses, or other services (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you must not use the Services.

2. Eligibility

LearnerBit is intended for students, parents, schools, and teachers. Children under 13 may use the Services only with verifiable parental or school consent. By using the Services, you confirm that you meet these eligibility requirements or have obtained necessary consent.

Access and use of the Services are strictly for personal and educational purposes. Users must comply with all applicable laws, regulations, and school rules while using the Services. Unauthorized commercial use, redistribution, or exploitation of the Services is prohibited.

5. Child Safety and Conduct

LearnerBit is committed to creating a safe and secure learning environment. Users must not post, upload, or share content that is harmful, abusive, offensive, or infringes upon another person’s rights. Any inappropriate behavior may result in account suspension or termination.

6. Parental and School Responsibilities

Parents and guardians are responsible for reviewing and managing their child’s data and ensuring appropriate use of the Services. Schools using LearnerBit must ensure compliance with applicable data protection laws, including obtaining necessary parental consent for students under relevant age limits. LearnerBit provides tools and support to assist schools in meeting these obligations but does not replace or assume any legal responsibilities of parents or educational institutions.

All content, materials, and digital resources provided by LearnerBit, including curriculum, course content, quizzes, teacher manuals, assessments, logos, and related educational materials, are proprietary to Brainy n Bright Inc. and its subsidiaries. Users may not reproduce, distribute, modify, store, or share these materials without explicit written permission. All trademarks, logos, and materials are protected under intellectual property laws.

8. Third-Party Services and Embedded Content

LearnerBit may include third-party tools, embedded content, or links to external websites. These third-party services may collect or process personal data independently. Brainy n Bright Inc. is not responsible for the privacy practices, content, or functionality of these third-party services. Users are encouraged to review their policies before use.

9. Payments and Refunds

Payments for courses or subscriptions are processed securely through third-party providers. LearnerBit does not store full credit card or sensitive financial information. Refund policies, if applicable, are provided during enrollment and will be subject to the terms outlined at the time of purchase.

While we strive to provide accurate and reliable educational content, LearnerBit makes no warranties or representations regarding the completeness, accuracy, reliability, or suitability of any content or Services. Students, teachers, and parents may create content such as assignments, projects, or feedback on the platform. Users retain ownership of their content but grant LearnerBit a non-exclusive, worldwide license to use, display, or distribute such content for educational, operational, or promotional purposes consistent with privacy and consent requirements.

14. Automated Tools and AI Recommendations

LearnerBit may use AI or LMS analytics to provide insights or recommendations that support student learning. Any automated decision-making affecting students’ learning outcomes is subject to human oversight to ensure fairness, accuracy, and compliance with ethical standards.

15. Privacy and Data Protection

The collection, use, and management of personal data by LearnerBit are governed by our Privacy Policy. Users are encouraged to review the Privacy Policy to understand their rights, parental consent requirements, and how their data is handled. These Terms shall be governed by and construed in accordance with the laws of the country in which Brainy n Bright is headquartered, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of that country.

20. Dispute Resolution

Any disputes arising out of or relating to these Terms or our Services will be resolved through binding arbitration in accordance with the rules of a recognized arbitration body (e.g., the American Arbitration Association if in the USA, or another appropriate international arbitration body depending on headquarters location). The arbitration will take place in the city where Brainy n Bright is headquartered. Each party will bear its own costs and expenses of such arbitration, and an award of arbitration may be enforced by any court of competent jurisdiction.
